Texoma Water Solutions - Oklahoma Terms & Conditions

GENERAL TERMS AND CONDITIONS

  1. Texoma Water Solutions is hereby authorized to make all corrections to existing plumbing deemed by Texoma Water Solutions to be necessary, so as to permit the water conditioning equipment to be installed on Customer's premises. Texoma Water Solutions assumes no responsibility or risk for failure of electrical current or of water supply, nor for lowering of water pressure, or for any damage resulting from any such events. Customer warrants that the drains for the disposal of water shall be kept open and shall be of sufficient size to carry away regenerating water from the system. TEXOMA WATER SOLUTIONS SHALL HAVE NO RESPONSIBILITY FOR CONSEQUENTIAL OR EXEMPLARY DAMAGES.
     

  2. Customer bears responsibility to notify Texoma Water Solutions promptly of any malfunctions or unsatisfactory water conditioning service or installation. Texoma Water Solutions shall provide service to the equipment without charge to the Customer throughout the life of a rental agreement or warranty provided by Texoma Water Solutions, after which time all repairs and costs will be the sole responsibility of the owner of the equipment. Such service is limited to that service which Texoma Water Solutions normally anticipates and regularly and customarily furnishes, including labor, materials, and replacements of worn or defective parts necessary to maintain the equipment in good working order.
     

Service will not include service to, or repairs or replacements of any portion of the equipment necessitated by the Customer's neglect, abuse, or wrongful act, or any other cause not reasonably within the power of Texoma Water Solutions to prevent or control. Service does not include cost of salt. Customer will assume full responsibility for the safekeeping of this equipment against fire, freezing, theft, and/or damage from other casualty or weather. Customer will not misuse, move, or alter the equipment. If automatic service, Texoma Water Solutions equipment is warranted to operate satisfactorily only when recharged with salt and/or chemicals and/or supplies purchased from and recommended by Texoma Water Solutions or equal; otherwise, service calls and damage to the equipment are Customer's responsibility and will be charged at the prevailing rates.
 

  1. Texoma Water Solutions shall not be responsible for any loss or damage to property, or bodily injury or death arising or resulting from any act or failure to act on the part of the Customer, or otherwise, after final installation has been made. Texoma Water Solutions shall not be responsible for damage or injury caused by delay in installation or service due to strikes, fires, accidents, or other causes beyond its reasonable control. Customer shall indemnify Texoma Water Solutions from and against all loss, damage, expense, or liability arising from any action on account of any injury to persons or property of any character whatsoever occasioned by or resulting from the operation or handling of equipment during the term of this lease, or while such equipment is in the possession, custody, and/or control of Customer.
     

  2. Customer agrees to pay any expenses, to the extent permitted by law, incurred by Texoma Water Solutions as a result of Customer's nonpayment of amounts due or cancellation of this agreement.
     

  3. This agreement represents the entire contract between Texoma Water Solutions and Customer. All parties agree that this agreement is governed by the laws of the State of Oklahoma. Any prior representations and/or warranties not contained herein are specifically excluded from this agreement. This agreement shall not be valid until it is signed and accepted by both Customer and Texoma Water Solutions.

     

SMS MESSAGING TERMS AND COMPLIANCE

SMS Data Protection Statement: Texoma Water Solutions does not share customer opt-in information — including phone numbers and consent records — with any affiliates or third parties for marketing, promotional, or any other purposes unrelated to providing our direct services. All text messaging originator opt-in data is kept strictly confidential.
 

  1. SMS Program Description: By providing your mobile phone number and opting in, you consent to receive SMS messages from Texoma Water Solutions related to appointment confirmations and reminders, customer service communications, account notifications and service updates, and marketing or promotional messages (only where separately consented). Consent to receive SMS messages is not a condition of purchase. Message frequency varies based on user interaction and service activity.
     

  2. Opt-Out Instructions: You may opt out of receiving SMS messages at any time by replying STOP to any message. After sending STOP, you will receive a confirmation message and no further messages will be sent unless you opt in again.
     

  3. Support Instructions: For assistance, reply HELP to any message, or contact us at will@texomawater.com or call 580-200-8280.
     

  4. Message and Data Rates Disclosure: Message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies. For questions about your text or data plan, contact your wireless provider.
     

  5. Carrier Liability Disclaimer: Mobile carriers are not liable for delayed or undelivered messages.
     

  6. Age Requirement: SMS services are intended for individuals 18 years of age or older. By opting in, you confirm that you meet this requirement.
     

  7. Privacy Policy: Information collected as part of the SMS program is subject to our Privacy Policy available at https://www.texomawater.com/privacy-policy-and-cookie-notice.
     

Summary: SMS use cases include appointment reminders, customer service notifications, account updates, and promotional messages (if opted in). Opt out at any time by replying STOP. For assistance, reply HELP or contact customer support. Message and data rates may apply. Mobile carriers are not liable for delayed or undelivered messages. Users must be 18 years of age or older to participate. We comply with applicable SMS communication regulations including TCPA and CTIA guidelines.
